A federal judge has ruled that David DePape will stand trial in San Francisco for the attack on Paul Pelosi, husband of former House Speaker Nancy Pelosi. DePape's defense team had requested a change of venue to Eureka, Oregon, citing concerns about media influence and Pelosi's popularity in the Bay Area potentially impacting jury impartiality. They presented a survey suggesting pre-existing beliefs of guilt among potential jurors. However, Judge Jacqueline Scott Corley rejected the request, stating the defense hadn't sufficiently demonstrated that Bay Area media coverage was disproportionately negative compared to other locations.

DePape is accused of breaking into the Pelosis' San Francisco residence on October 28, 2022, intending to kidnap the then-Speaker, who was away at the time. Instead, he allegedly assaulted Paul Pelosi, 83, with a hammer. Bodycam footage of the incident was publicly released in January, following a judge's denial of the prosecution's request to keep it confidential.

DePape, 43, has pleaded not guilty to federal charges of attempted kidnapping and assault of a federal official's family member. He has also entered not guilty pleas to state charges, including attempted murder, burglary, and elder abuse. He is currently being held without bail.
The federal trial is scheduled to commence on November 13, while a date for the state trial is yet to be determined.
