The incident occurred in November 2019 when officers arrived at Swanson's Ossipee residence to apprehend him after he allegedly made threatening calls to law enforcement. Swanson reportedly refused to exit his home, and officers heard gunshots originating from within. According to reports, Swanson then emerged from the house carrying a loaded rifle, prompting three troopers to open fire, striking him in the shoulder, forearm, and buttocks. Swanson survived the shooting, and no other individuals were injured.

In 2020, the attorney general's office concluded that the troopers' use of deadly force was justified. However, the recent competency hearing led to the dismissal of the charges against Swanson.
