Following his acquittal in the highly publicized chokehold death of Jordan Neely, Marine veteran Daniel Penny expressed gratitude towards the jury. In an exclusive interview preview with Fox Nation's Judge Jeanine Pirro, Penny conveyed his appreciation for their courage in the face of what he described as a challenging New York City climate. He stated a desire to personally thank each juror for their decision.
Penny's legal team, Steven Raiser and Thomas Kenniff, shared their anxieties during the trial, particularly after the dismissal of the second-degree manslaughter charge. They voiced concerns that the jury's initial indecision on the top charge could influence their verdict on the lesser charge of criminally negligent homicide. Raiser also highlighted the defense team's unease regarding what he perceived as the District Attorney's office's determined pursuit of a conviction. He characterized the prosecution's approach as unusual and unsettling.

Penny maintained that he would act similarly if confronted with a comparable situation involving perceived threats and erratic behavior. He expressed a sense of moral obligation to intervene, stating that inaction would lead to lifelong guilt. The architecture student emphasized his belief in the seriousness of Neely's threats, characterizing the incident as unlike any prior experience on the city's subway system. He asserted that Neely's words conveyed a genuine threat, leading him to fear for the safety of others present.

Despite the acquittal, Penny faces a civil lawsuit filed by Neely's father, Andre Zachery, alleging negligence and recklessness. Zachery is pursuing unspecified damages for assault and battery.
