Delaware's U.S. Attorney David Weiss has reaffirmed to Senator Lindsey Graham that he hasn't sought special counsel status in the Hunter Biden investigation, aligning with Attorney General Merrick Garland's statements. In a letter obtained by Fox News, Weiss confirmed he discussed obtaining authority under 28 U.S.C. § 515 with Department of Justice officials. This would have empowered him to pursue charges outside of Delaware without needing collaboration from a local U.S. Attorney. Weiss stated he received assurances this authority would be granted if required, well before the October 2022 meeting central to the whistleblowers' allegations. He emphasized following established procedures and never being denied the ability to file charges in any jurisdiction. Weiss's communication marks the third instance he has publicly countered IRS whistleblower Gary Shapley's claims. Shapley alleges Weiss privately admitted to lacking control over the investigation on multiple occasions. The House Ways and Means Committee recently disclosed testimonies from Shapley and another whistleblower, alleging interference from the DOJ, FBI, and IRS in the Hunter Biden tax evasion investigation. Shapley claims the IRS possesses a 2017 WhatsApp message from Hunter Biden to Henry Zhao, reportedly a Chinese Communist Party official. The message allegedly shows Biden leveraging his father's presence to pressure Zhao regarding an unfulfilled commitment.
