Trump Backs Texas and Missouri in Fight Against Biden Administration's Border Wall Material Sales

Former President Donald Trump has formally supported Texas and Missouri's legal challenge against the Biden administration's sale of border wall materials. Trump filed an amicus brief arguing that the sales should be halted immediately, potentially representing criminal activity. The states had previously sought a status conference to assess whether the administration violated a court injunction prohibiting the repurposing of funds allocated for wall construction.

Trump's brief urges the court to thoroughly investigate the government's actions, including through formal discovery if necessary, to ensure compliance with the law, the Constitution, and the existing injunction. He alleges that the Biden administration is intentionally selling the materials at a loss to obstruct his and Congress's border wall policy, suggesting this could constitute a conspiracy to defraud the United States.

The Biden administration has been auctioning off border wall components since at least 2023, following the halt of construction in 2021. These auctions have continued weekly, attracting renewed attention with recent reports and videos of the materials being transported.

A Defense official stated that the Pentagon's disposal of surplus wall materials aligns with the 2024 National Defense Authorization Act. The official asserted that border states were offered the materials before the auctions and that the Department of Defense no longer has authority over the sold items. Despite this, Republican lawmakers remain critical of the auctions, viewing them as an attempt to prevent future wall construction. Senator Bill Hagerty introduced legislation to stop the sales.

Trump has stated he collaborated with Texas Attorney General Ken Paxton and others to acquire the materials, criticizing the administration's actions as potentially criminal and wasteful. Texas has expressed its intention to support the incoming Trump administration's efforts to build the wall. Texas Land Commissioner Dawn Buckingham criticized the Biden administration's actions and offered state land to store any wall panels acquired by the incoming administration.
